Illinois Marijuana Penalties

Medical marijuana has been legalized in Illinois. But any patient or caregiver who has been certified and registered to use medical cannabis must not be in possession of more than two-and-a-half ounces for a 14-day period. So, you need to be aware of the following penalties that apply to possession, use, distribution, cultivation of marijuana in Illinois.

Possession of Marijuana for Personal Use

A person in who is in possession of 10g of marijuana or less is subject to a $100 to $200 fine without any jail term. Possession of 10 to 30 grams of marijuana is punishable by a prison sentence of one year and a maximum fine of $2,500 for first-time offenders. For a second offender found with 10 to 30 grams of marijuana, the offense is a felony, and it attracts a jail term of one to six years and a fine of $25,000.

Possession of 30 to 500 grams of marijuana is punishable by a jail term of one to six years and a fine of $25,000 for first offenders. Second offenders in possession of 30 to 500 grams are punishable by a prison sentence of two to five years and a fine of $25,000.

Possession of 500 to 2,000 grams of marijuana is punishable by a prison sentence of two to 10 years and a fine of $25,000. Possession of 2,000 to 5,000 grams of marijuana is punishable by a jail term of three to 14 years and a fine of $25,000.

Possessing Marijuana With Intent to Sell or Distribute

Possessing 2.5 grams or less of marijuana with the intent to sell it is punishable by a maximum jail term of six months and a fine of $1,500. Having 2.5 to 10 grams yields a maximum jail term of 12 months and a fine of $2,500.

Possession of 10 to 30 grams of marijuana with the intent to sell is punishable with a jail term of one to six years and a fine of $25,000. Having 30 to 500 grams of marijuana with intention to sell it is punishable by a jail term of two to 10 years and a fine of $50,000.

Delivering Marijuana on School Grounds

A person who delivers 2.5g of marijuana on the grounds of any school is subject to a maximum fine of $2,500 and a maximum jail term of 12 months.

Delivery of 2.5 to 10 grams of marijuana on school grounds is punishable by a jail term of one to six years and a fine of $25,000.

Cultivation

Cultivating five or fewer marijuana plants is a misdemeanor punishable by a sentence of 12 months in prison. Cultivating five to 20 plants leads to a 12-month prison sentence and a maximum sentence of six years, with a $25,000 fine.

Cultivation of 20 to 50 plants yields two to 10 years of incarceration and a $25,000 fine. Cultivating 50 to 200 plants is punishable by a prison sentence of three to 14 years and a fine of $100,000.

Avoid Medical Marijuana Penalties in Illinois By Getting Certified

As of June 30, 2016, doctors are required to certify that they have bona fide doctor-patient relationships with their patients. Physicians must then provide a statement to prove that the patient has one of the qualifying conditions for medical marijuana.
