Texas has some of the most limited weed laws in the United States. Right now, only patients who have been diagnosed with a limited list of serious conditions may access medical cannabis in Texas.

Medical Marijuana Facts for Texas

• Only patients who have been diagnosed with one of the following conditions may legally access medical marijuana in Texas: epilepsy, a seizure disorder, multiple sclerosis, spasticity, amyotrophic lateral sclerosis, autism, terminal cancer or an incurable neurodegenerative disease.
• These conditions must be diagnosed by a qualified physician.
• Patients who can access medical marijuana in Texas may only purchase the cannabis products from one of three licensed Texas dispensaries.
• The three licensed dispensaries are: Fluent, Compassionate Cultivation and Surterra.
• Patients may not smoke cannabis products. They must consume them in the form of an inhaler or oil.
• Texas has placed a limit on how much THC these medical marijuana products can contain. State law limits the amount to 0.5 percent THC or less.
• Only some physicians will be considered qualified to prescribe medical marijuana in Texas. Physicians must show proof of one or more board certifications in a specialty that is relevant to the patient’s treatment. The certification must come from a specialty board.
• Physicians must create and maintain a treatment plan for each patient that describes details like the duration of treatment and the dosage of medical marijuana. They must also describe how the cannabis will be administered.
• Only permanent residents of Texas may obtain medical cannabis in the state. People cannot come from other states to obtain Texas medical marijuana.
• The first law to allow for the use of medical marijuana in Texas was called SB 339, or the Texas Compassionate use Act. It was enacted in 2015 and only allowed patients diagnosed with epilepsy to use medical marijuana.
• In 2019, Texas lawmakers expanded access to medical marijuana with HB 3703. The new law added a handful of additional medical conditions that patients may use medical marijuana to treat.
