The West Virginia Legislature has passed Senate Bill 386 to legalize medical marijuana. The bill, which clearly articulates the West Virginia medical marijuana qualifications, was signed by Gov. Jim Justice on April 20, 2017. His signing of this important legislation brings new hope to patients in West Virginia.
Through the new medical marijuana program, patients with qualifying medical conditions will be permitted to possess the approved amount of cannabis after obtaining a written certification from a licensed doctor.
Patients in West Virginia who are diagnosed with one or more of the following severe, life-threatening or debilitating medical conditions are allowed to use medical cannabis under the new West Virginia Medical Cannabis Act:

The certifying physician must assess the patient’s medical history and present medical condition and the patient must have a condition included in the medical marijuana qualifications for West Virginia.
A qualifying patient may receive medical marijuana treatment directly if he or she is 18 years or older. A patient who is younger than 18 years of age will receive treatment through a registered caregiver.
A qualifying patient may have any other medical condition for which standard medical treatments have proved ineffective, provided their doctor confirms the symptoms can be relieved by medical cannabis.
