Recreational marijuana is legal in Michigan, and the state also has a well-established medical marijuana program. But state law still classifies marijuana as a Schedule I controlled substance, and there are laws regulating its possession, sale, distribution and cultivation.
Possession of Marijuana for Personal Use
Possession of up to 2.5 ounces of marijuana, or up to 10 ounces in one’s own home, is legal. Possession of 2.5 ounces to five ounces is a civil infraction, with a first offense punishable by a maximum fine of $500. Possession of more than five ounces is a misdemeanor, also subject to a $500 fine for the first offense.
Distribution or Sale of Marijuana
There is no penalty for distributing less than 2.5 ounces of marijuana without remuneration. Giving away 2.5 ounces to five ounces is a civil infraction subject to a $500 fine. The sale of marijuana is a felony, with penalties ranging from up to four years in prison and a $20,000 fine for less than five kilograms to 15 years in prison and a $10 million fine for 45 kilograms or more.
There is no penalty for the sale of marijuana paraphernalia.
Cultivation
It is legal to grow as many as 12 plants for personal use. Cultivation of 12 to 24 plants is a civil infraction subject to a $500 fine. Growing 25 or more plants is a felony, with penalties ranging from seven years in prison and a maximum fine of $500,000 to 15 years in prison and a fine of up to $10 million.
