New Hampshire CBD Program

Because of its differences from marijuana, some states separate the compound cannabidiol (CBD) from cannabis in the law. Regular marijuana contains tetrahydrocannabinol (THC), which causes psychoactive effects. Meanwhile, separating CBD from cannabis results in a product with much less THC. You can also find more CBD and less THC in hemp, which sometimes has distinct state laws. New Hampshire law has a few of these legal differences going on.

CBD Laws in New Hampshire

Most forms of CBD medicine fall under New Hampshire’s medical marijuana program. State laws often consider cannabis with less than 0.3 percent THC hemp. Anything that goes over that limit gets categorized as marijuana. The majority of CBD that comes from marijuana keeps at least 0.3 percent of the original THC. Meanwhile, hemp plants already have genetics that give their extracts low THC.

New Hampshire doesn’t have many laws that distinguish marijuana and hemp. As of October 2018, the state House plans to research hemp’s industrial uses. But, they have not made anything official. This lack of clarity leaves the rules up to federal law, which puts hemp in a gray area. Some experts believe federal law allows the sale of hemp CBD, while others don’t. However, you can find hemp CBD oil in plenty of retail stores. Many people buy it without worry of arrest.

Overall, patients have the most protections when they join the state medical marijuana program. Having a medicinal cannabis card lets them get CBD medicine legally under state law.
