Washington Medical Marijuana Penalties

Washington was among the first states to legalize marijuana for medical and recreational use. Adults 21 years and older can possess up to one ounce of dried cannabis, up to 16 ounces of cannabis-infused solid products and up to 72 ounces of cannabis-infused liquid products.

Possession for Personal Use

Possession of more than one ounce but less than 40g of marijuana results in a 24-hour mandatory minimum sentence and a maximum of 90 days in prison. For first-time offenses, a mandatory fine of $250 is imposed, and for second and subsequent offenses, it’s a mandatory fine of $500.

According to Washington law, the imprisonment will not be deferred or suspended unless it is proven that the jail term will pose a risk to the offender’s physical and mental health or if the local prison facility is overcrowded.

Possession of 40g or more is classified as a Class C felony. It incurs a prison sentence of up to five years and a maximum $10,000 fine. An additional mandatory fine of $1,000 applies for first-time offenses, and a $2,000 fine applies for a second or subsequent offense.

Possession With Intent to Distribute

Possession with intent to distribute any amount of cannabis is classified as a Class C felony and attracts a maximum sentence of five years in prison along with a maximum $10,000 fine.

An additional mandatory $1,000 fine applies for a first-time offense and a $2,000 fine for a second or subsequent offense.

Sale or Distribution

State-license providers may only sell cannabis to those who are at least 21 years of age. Sale by unlicensed providers is subject to penalties ranging from fines to incarceration.

Sale or distribution of any amount of cannabis is considered a Class C felony and attracts a sentence of up to five years in prison and a fine no greater than $10,000. An additional mandatory $1,000 fine applies for a first-time offense and a $2,000 fine for a second or subsequent offense.

Distribution by a person 18 years of age or older to another person under 18 years who is three years the seller’s junior is classified as a Class B felony and attracts a double sentence of up to 10 years in prison and a maximum $10,000 fine.

Cultivation

Cultivation for either personal use or with intent to distribute is classified as a Class C felony and is subject to a maximum sentence of five years in prison and a fine no greater than $10,000.

An additional mandatory $1,000 fine applies for a first-time offense and a $2,000 fine for a second or subsequent offense.

Hash and Concentrates

Selling hash and concentrates is punishable by a maximum of five years in prison and a fine no more than double the value of the hashish and concentrates. Subsequent offenses attract a mandatory imprisonment of five years and a fine no greater than double the value of the hashish and concentrate.

Manufacturing, distributing or trafficking with intent to sell or transport hashish and concentrates is a crime punished by a maximum sentence of 10 years in prison and a fine of up to $20,000 or four times the value of the hash and concentrates.

Any person 21 years or older with a valid ID from any US state can purchase marijuana in Washington legally. Purchases include both marijuana and marijuana-infused products along with apparatuses such as pipes, papers and lighters.
