Defenses Provided:

Nevada’s medical marijuana law provides exemption from prosecution if you are in lawful possession of a registry card (aka marijuana medical card). It also provides an affirmative defense if you are not registered but are in compliance with the law.

Medical Marijuana Uses:

Under Nevada medical marijuana law, medical cannabis may be used if you suffer from any of the following conditions:

Cancer, HIV/AIDS, multiple sclerosis, epilepsy or other seizure disorder, or spasticity disorders; intractable pain; glaucoma, either acute or chronic; Crohn’s disease; Hepatitis C; or any disease, including anorexia, which results in nausea, vomiting, wasting, appetite loss, cramping, seizures, muscle spasms, and/or spasticity, when these symptoms are unrelieved by standard treatments.

Documentation Needed:

In order to qualify for medical marijuana in Nevada, you must diagnosed within 12 months prior to arrest with a qualifying condition, and you must be advised by your attending physician that marijuana “may mitigate the symptoms or effects” of the debilitating condition. Marijuana Card Program:

To become a medical marijuana patient in Nevada, you must register with Nevada State Health Division’s Medical Marijuana Program to receive a registry card (aka marijuana card).

Cannabis Possession and Growing Limits:

Medical cannabis patients in Nevada may possess up to one usable ounce and seven plants, three of which may be mature; patients may use affirmative defense to argue that greater amounts are medically necessary. Nevada does not provide any legal means of purchasing medical marijuana at this time.

Caregiver Provisions:

Medical Marijuana patients in Nevada may designate a caregiver to possess, transport and grow cannabis on the patient’s behalf. There may only be one caregiver per patient, but caregivers may serve multiple patients simultaneously.
