Defenses Provided:

Montana medical marijuana laws provide exemption from prosecution for patients in lawful possession of a medical marijuana card. Patients who are not registered with the cannabis card system but are in compliance with the law are granted an affirmative defense.

Medical Marijuana Uses:

Under Montana medical marijuana law, medical cannabis may be used for the following conditions: cancer, glaucoma, HIV/AIDS, or a chronic or debilitating disease or medical condition or its treatment that produces one or more of the following: cachexia or wasting syndrome; severe and chronic pain; Severe nausea; Seizures, including those characteristic of epilepsy; or severe and persistent muscle spasms, including those characteristic of Chron’s disease or multiple sclerosis.

Documentation Needed:

In order to qualify for medical marijuana in Montana, patients must obtain a valid, written documentation from a licensed physician stating that the patient has been diagnosed with a debilitating medical condition and that “potential benefits of the medical use of marijuana would likely outweigh the health risks for the qualifying patient”

Marijuana Card Program:

Medical marijuana patients must register with the state Department of Public Health and Human Services to obtain a medical marijuana card.

Cannabis Possession and Growing Limits:

Medical cannabis patients are legally allowed to possess one usable ounce of medical pot and are permitted to grow or cultivate up to six cannabis plants.

Caregiver Provisions:

Medical Marijuana patients in Montana may designate one caregiver to obtain cannabis on the patient’s behalf.
