Hawaii Medical Marijuana Program: Telemedicine

As defined in section 269-1 of the Hawaii Statutes, telehealth is defined as “the use of telecommunications, including but not limited to secure interactive and non-interactive web-based communication, real-time video conferencing-based communications, asynchronous information exchange security, transmission of patient medical records and information — including the medical diagnosis and interpretation of diagnostic-quality digital images and laboratory results — in order to deliver enhanced health care services and information to parties located in different locales”.
Hawaii legislature enacted a private insurance parity law, Senate Bill 2469, requiring all Hawaii private payers, and Hawaii Medicaid, to recognize and reimburse telemedicine services at the same rates as the equivalent health care service provided in-person — however, the law requires that a telepresenter be present, except in cases concerning behavioral health services.

Hawaii regulation requires that all health care practitioners providing telemedicine services are required to first establish a physician-patient relationship with a patient, prior to providing a diagnosis or treatment — however, telemedicine may be used to satisfy this requirement.

  • The State of Hawaii requires that, in order for a marijuana doctor to conduct a medical marijuana evaluation, the physician must first conduct a patient examination, in-person.
